A statement issued by EACC revealed that Antony Muhanji, through his private company Mukitek Investment Limited, fraudulently secured a tender to undertake excavation and concrete works at KPA.
This was discovered when EACC launched a probe after its regional office in Mombasa received an allegation of fraudulently procured funds from KPA.
Following the probe, EACC discovered that the tender was acquired through forged documents and that Muhanji supervised the excavation as the Project Manager.
EACC then immediately froze Ksh.52,191,704 awarded to Muhanji, pending finalization of investigations.
"The purpose was to ensure that in the event the Commission wins the recovery suit, any forfeiture and reinstitution orders issued by the Court will not be in vain," reads part of the statement.
EACC then filed a suit on Monday noting that the Ksh.78M is a proceed of crime and should therefore be paid to the government.
The suit further wanted that the frozen monies should also be forfeited to the government.
