A petition for amendments to the customary land and inheritance laws was officially presented to the Speaker of the National
Assembly, Moses Wetangula, on Wednesday, marking a pivotal moment in Kenya’s
efforts to address long-standing injustices that have plagued many families in
Kenya.
The petition was submitted by Agricultural Finance
Corporation (AFC) chairperson and former Governor of Taita Taveta John Mruttu,
signaling the official start of the reform process.
A date for the debate on the matter has already been set,
indicating the momentum behind this transformative initiative.
For decades, Kenya’s legal system surrounding inheritance
has been criticized for its complexity, high costs, and lengthy procedures,
leaving vulnerable groups, such as widows, orphans, and youth, struggling to
access land that is rightfully theirs.
These individuals often find themselves unable to claim,
use, or develop land due to cumbersome legal hurdles, preventing them from
improving their livelihoods and contributing to the country’s economy.
In his petition Mruttu emphasized that the reforms aim to
create a more accessible, dignified, and efficient system for land ownership.
The proposed changes seek to simplify inheritance
procedures, ensuring that widows will no longer endure prolonged legal battles
to claim their homes, orphans will not be deprived of their inheritance, and
youth will have the opportunity to utilize inherited land to build their
futures without resorting to lengthy court cases.
“These reforms are not just about legal clarity; they are
about restoring dignity, unlocking opportunities, and providing justice to
those who have suffered for too long,” Mr. Mruttu said.
If passed, the amendments will pave the way for a land
inheritance system that is easier to navigate and equitable for all Kenyans.
This change is expected to have a particularly significant
impact on the agricultural sector, promoting economic growth by making land
ownership more accessible for small-scale farmers and youth interested in
agribusiness.
