CJ Martha Koome picks 3-judge bench to hear Finance Act case

High Court Justice David Majanja is set
to lead a three-judge bench constituted by Chief Justice Martha Koome to hear
the Finance Act, 2023 case.
The other two judges also appointed to the
bench are Lady Justice Christine Meoli and Justice Lawrence Mugambi.
The
Judiciary, in a notice seen by Citizen Digital on Thursday, said the case has
been set for physical mention on Monday next week at 10am.
“Parties are only allowed to avail a maximum
of 3 Counsels and 1 assistant, with an exception of Mr Eliud Matindi,” read the
notice.
The
two parties are therefore required by the court to provide a list of the
aforementioned choices by the close of business on Thursday in order to allow
room for planning and preparation.
This
comes after the Court of Appeal last week lifted conservatory orders barring the
implementation of the Finance Act, 2023 following an appeal by Treasury Cabinet
Secretary Prof. Njuguna Ndungu.
The move paved way for the government to
implement critical taxes that had been put on hold following the Act’s suspension
late last month.
The
controversial law had been temporarily suspended after Busia Senator Okiya
Omtatah together with other activists challenged its implementation.
Omtatah and
the three others including Eliud Karanja Matindi, Benson Odiwuor Otieno, and
Brian Angima Oigoro, have since filed an appeal against the Court of Appeal
ruling.
