A parent has sued St. Bakhita School in Nairobi, seeking
damages after his daughter in Grade Five was allegedly subjected to a vicious
attack by a teacher, resulting in visible injuries and psychological trauma.
Acting on behalf of the minor, the father has filed a case in
court seeking special damages amounting to Ksh.18,000.
In the suit, the father holds the school’s board of directors
liable for the incident, claiming they failed in their duty of care.
According to court documents, the Grade 5 pupil was assaulted
by a Kiswahili teacher during a lesson.
It is alleged that the teacher pulled the girl's left ear,
causing visible injuries. She was treated at a hospital and later discharged.
The petition further states that the teacher’s actions were
deliberate, premeditated, and intended to cause extreme pain and suffering. It
also notes that the child continues to attend the hospital for routine medical
check-ups.
Through lawyer Wycliffe Nyabuto, the parent argues that the
teacher violated the minor's rights and is calling on the court to declare the
Kiswahili teacher unfit to teach anywhere in Kenya.
