In a statement on Thursday, October 15, 2026, Natembeya said the withdrawal had occurred for the second time, raising concerns over the procedures followed by the relevant authorities and the reasons behind the decision.
The governor cited Article 47 of the Constitution, which guarantees every person the right to administrative action that is lawful, reasonable and procedurally fair.
He argued that any decision affecting his security should be accompanied by written reasons and comply with the applicable legal requirements.
“I therefore call upon the Inspector-General of the National Police Service to provide a formal explanation of the reasons for this decision and to clarify whether the applicable security procedures have been followed,” Natembeya stated.
The governor also referred to a High Court ruling reported on June 3, 2025, concerning the withdrawal of security assigned to five governors.
According to Natembeya, the court held that withdrawing security without prior written notice, an opportunity to be heard and written reasons violated Article 47 of the Constitution.
He urged the authorities to take the judicial pronouncement into account when making decisions concerning security arrangements for public officials.
Natembeya further cited Article 238(2)(b), which requires national security operations to be conducted in accordance with the law while respecting democracy, human rights and fundamental freedoms.
He also invoked Article 244 of the Constitution, which outlines the National Police Service’s obligation to maintain professionalism and discipline while respecting human rights and human dignity.
Natembeya clarified that he was not opposed to lawful reviews of security arrangements but insisted that such decisions must be made objectively and professionally.
"Let me be clear: I do not claim immunity from lawful security reviews. What I insist upon is that any such review must be conducted professionally, objectively and in accordance with the Constitution, without discrimination or improper political influence,” he said.
The governor called for clarification on the repeated withdrawal and urged the relevant authorities to ensure appropriate security arrangements are maintained in accordance with the law.
He maintained that the development would not distract him from discharging his constitutional responsibilities to the people of Trans Nzoia.
Natembeya concluded by stressing that all public institutions are bound by the Constitution and that no Kenyan should be denied the right to procedural fairness.
