Lumakanda OCS denied bail in case involving alleged defilement of 14-year-old child

The Officer Commanding Station (OCS) at Lumakanda Police Station, Wycliffe Kwendo, will remain in custody after the Kakamega Law Courts denied him bail in a case involving the alleged defilement of a 14-year-old child.

Kwendo is facing a main charge of defilement, an alternative charge of committing an indecent act with a child, and a separate charge of abuse of a position of authority. He has denied all the charges.

Prosecutor Ian Makotsi opposed the bail application, arguing that Kwendo's position as a serving police officer gave him the ability to interfere with witnesses.

The prosecution also alleged that Kwendo threatened witnesses with a firearm during his arrest. The court was further told that the complainant and other witnesses live within the officer's area of command.

Senior Resident Magistrate Dorcas O. Mac'andere ruled that the prosecution had demonstrated a real and substantial risk of witness interference.

The magistrate cited Kwendo's position of authority, the vulnerability of the child complainant, the location of the witnesses within his area of command and the alleged firearm threats as factors supporting the decision to deny bail.

The court also found that imposing strict bail conditions would not sufficiently protect the complainant or preserve the integrity of the proceedings.

Kwendo will remain at Kakamega GK Prison as the case proceeds.

The matter will be mentioned on October 15, 2026, for pre-trial directions and to confirm compliance with the court's orders.
