Kindiki appeals ruling admitting Dr Gikonyo's affidavit in Gachagua impeachment case

Deputy President Kithure Kindiki has filed a notice of appeal challenging a ruling by a three-judge bench that admitted into court an affidavit sworn by Dr. Daniel Gikonyo.

In the notice of appeal, Prof. Kindiki says he is dissatisfied with the decision delivered on May 7, 2026, by Justices Ogola, Mrima and Mugambi, and intends to move to the Court of Appeal to challenge the ruling in its entirety regarding the admissibility of the affidavit.

“That Prof. Kithure Kindiki, the 2nd Interested Party herein, being dissatisfied with the Ruling delivered by this Honourable Court (Ogola, Mrima and Mugambi JJ.) on 07 May 2026, intends to appeal to the Court of Appeal against all such parts of the Ruling as found and held that the Affidavit sworn by Dr Daniel Kibuka Gikonyo together with the annexures thereto is admissible and duly filed and served,” reads part of the notice of appeal.

The appeal now sets the stage for a fresh legal battle before the Court of Appeal over the admissibility of the affidavit and supporting documents filed by Dr. Gikonyo in the ongoing proceedings.
