KECOBO directs CMOs to cease operations amid licensing limbo

The Kenya Copyright Board (KECOBO) has announced a temporary suspension of operations for Collective Management Organisations (CMOs) until new licences are issued. 

In a press release issued on Wednesday, KECOBO stated that the six-month provisional licences granted to three CMOs—Music Copyright Society of Kenya (MCSK), Kenya Association of Music Producers (KAMP), and Performers Rights Society of Kenya (PRISK)—on November 8, 2023, had expired.

"Consequently, the CMOs have been instructed to halt operations until either their licenses are renewed or new licenses are issued, a process contingent upon the High Court's decision on May 30, 2024," stated Joshua Kutuny, Chairman of KECOBO.

The lapse of these licences is due to a petition filed at the High Court on March 28, 2024, by an interested party, which prompted the court to issue restraining orders against KECOBO, suspending the issuance of operating licences until the petition is adjudicated.

KECOBO, which is authorised to regulate and oversee CMO activities under copyright law, received applications from five organisations on 10 April after inviting new licence applications. 

Along with MCSK and KAMP, Collective Management Services (CMS) Ltd, Performing and Audiovisual Rights Society of Kenya (PAVRISK)—formerly PRISK Ltd, and Film Maker Rights Achievers of Kenya (FRAK) Ltd submitted applications.

"In response to our advertisement, KECOBO has received written submissions from stakeholders regarding the suitability of the five applying CMOs," KECOBO explained. 

"Currently, the KECOBO secretariat is diligently compiling a report based on these applications and written submissions, laying the groundwork for a forthcoming physical public participation forum scheduled to convene in Nairobi later this month."
