Judge directs exhumation in probe of refugee student’s killing

According to the Office of the Director of Public Prosecutions (ODPP), Senior Principal Magistrate Evans Muleka instructed a relative of the deceased, Hussein Bilal, to identify the exact burial site to facilitate the exhumation and allow forensic experts to undertake fresh examinations.
The court further ordered the Chief Government Pathologist to oversee the exhumation and lead the second autopsy. Specialists from the Government Chemist will also collect samples for forensic analysis.
Additionally, the Directorate of Criminal Investigations (DCI) has been tasked with documentation of the process, while the Fafi Sub-County Public Health Officer will ensure all required safety measures are followed.
The court directed that Hussein, or a representative designated by him, be present during the procedure. Dr. Chweya Arthur, who performed the initial autopsy, is also expected to attend.
These directives follow the recent arrests of four suspects—Shafa Bilal Sharkane, Abubakar Abdullahi, Halima Muhumud Mogow, and Zeynab Salat Samatar—who are being investigated in connection with the killing of the Grade 9 refugee student at a school in Garissa. The suspects were remanded for 20 days as investigations continue.
Investigators told the court they require additional time to gather evidence, including DNA samples and witness statements, and to ensure the safety of all parties due to the region’s proximity to the Somalia border.
The ODPP indicated that murder charges are expected to be formally filed once the new forensic findings are complete.
“The exhumation is expected to provide crucial forensic evidence to support ongoing investigations and aid in the prosecution of those responsible for Safiya Hussein Bilal’s death,” the ODPP said in a statement.
