Democracy for the Citizens Party (DCP) leader Rigathi Gachagua has vowed to return to court once again in a bid to challenge his impeachment from the Deputy President's office which he maintains was fraudulent.

According to the DCP boss, he has built a watertight case proving he was ousted on unconstitutional grounds, saying that he will bank on the integrity of the judicial system to grant him deserved justice. 

"I will be in court from tomorrow to Wednesday to file a petition challenging that illegal process. I told my children about it and they opposed it saying I faced humiliation. My children were traumatised that a man we had helped to be President was embarrassing us before the people of Kenya," he said speaking in Bamburi, Mombasa County on Sunday.

"We have faith in our judicial system that it should be able to give justice to Rigathi Gachagua and my supporters. We have faith that three judges will do what is right and apply the law. All we are asking for is justice and impunity should not rule over this country."

The former premier was backed by Wiper party leader Kalonzo Musyoka, who said that the petition will reveal a heap load of illegalities committed during the impeachment process, claiming that among them is soliciting of bribes in the National Assembly and the Senate.

"We know some of them were bribed and even some confessed that they were given between Ksh.10 to Ksh.20 million. All this will be revealed in court," Kalonzo noted

On May 9, 2025, the Court of Appeal quashed a decision by Deputy Chief Justice Philomena Mwilu made on October 18, 2024, to constitute a three-judge bench to hear a petition challenging Gachagua’s removal from office. 

DCJ Mwilu had appointed Justices Eric Ogolla, Anthony Mrima, and Freda Mugambi to hear the case, an action Gachagua’s legal team challenged as unconstitutional, arguing that only the Chief Justice has the authority to make such appointments. 

The High Court has since postponed proceedings in the constitutional petition involving Gachagua following the Court of Appeal decision.

Upon his removal from office in October 2024, Gachagua became the first deputy president of Kenya to be impeached, having served the shortest period as DP under the 2010 constitution.

He has since joined a United Opposition front that has vowed to stage a stiff competition against President William Ruto, to oust from power in the 2027 General Election.
