Gatundu: Three suspects arraigned over alleged sodomy of mentally incapacitated man

Three middle-aged men have been arraigned at the Gatundu Law Courts over allegations that they sodomised a young man in Gatundu Town.

The three—Kelvin Muhoho, Daniel Kung’u and George Ndarwa—are also accused of severely injuring the complainant’s private parts.

The complainant is said to be mentally incapacitated and is currently admitted at Gatundu Level Five Hospital, where he is recovering.

They appeared before Gatundu Senior Resident Magistrate Shadrack Otuke.

Investigating officer Fredinah Kabuyesi, through the prosecution, filed a miscellaneous application seeking to have the suspects detained for five days to allow completion of investigations.

The prosecution argued that if released on cash bail, the suspects could interfere with witnesses who are yet to record statements

It also told the court the suspects have no known fixed places of residence, and that they risk being subjected to mob justice if released.

However, Magistrate Otuke said the prosecution had not demonstrated how the suspects would interfere with the case if freed.

He nonetheless noted the allegations are sensitive and sexual in nature, and allowed the State to detain the suspects for three days at Gatundu South Police Station.

The matter will be mentioned on February 5, 2026.
