The accused are Rose Mbithe Mulwa, her children Chris Mulwa and Angela Mulwa, and police constables Julius Cheruiyot and Kennedy Kipkemei.
They are accused of planning the murder of Mbobu, who was shot dead in traffic along Magadi Road on September 9, 2025, while heading home from his office in Nairobi’s Central Business District.
The court was also informed that Inspector Kenneth Kipkeboi Sang, who had been on the run, was arrested on Saturday night and is expected to face a similar charge.
Sang is suspected of involvement in the murders of both Mbobu and Dr. Victoria Nthunya Mutiso. Investigators have previously told the court that a firearm allegedly issued to Sang was linked through ballistic analysis to evidence recovered in the investigations.
The case marks a second murder trial involving Rose Mulwa and her children, who are also facing charges in connection with the killing of Dr. Mutiso.
During the court proceedings, defence lawyer Kepher Ojijo raised concerns over the prosecution’s handling of an affidavit ahead of the hearing, saying the defence had expected the document to be filed before the court session.
“My Lady, when we came here, our understanding was that upon plea, we were supposed to make our application, which you have given direction. But again, the prosecution had given this information three weeks ago, and they knew we were coming here. We expected that maybe that affidavit would have been filed before this court,” Ojijo said.
Prosecuting counsel Jalson Makori told the court that the prosecution was obtaining new information that it intended to include in the affidavit. He said the prosecution was agreeable to the court’s direction to file written submissions.
“There is new information which we are getting and which we wanted to include in the affidavit. For that reason, we are okay with the direction that we do file written submissions,” Makori said.
Justice Diana Kavedza directed the parties to return to court on the scheduled dates for the pre-bail report and bail submissions.
“See you on the 19th, virtual, because you have to confirm you all have the pre-bail report. Then bail submissions on the 24th at 11, physical,” Justice Kavedza said.
Sang was arrested in Eldoret following an intelligence-led operation and transferred to Nairobi. Investigators had sought 14 days to detain him to complete inquiries into the two killings, record his statement, conduct searches and pursue possible recoveries before charging him.
The Directorate of Criminal Investigations also said it wants to complete outstanding investigations and have Sang undergo a mental assessment before his appearance for plea-taking.
