Court raises concern over contradictory findings on Kalombotole’s mental state

The court noted after conflicting medical reports were presented regarding Kalombotole’s mental condition, with one assessment declaring him unfit to plead and another finding him fit to stand trial.

Murder suspect Kennedy Kalombotole could be referred to South Africa for further psychiatric evaluation if a panel of three psychiatrists from Mathari National Teaching and Referral Hospital fails to reach a conclusive finding on his mental fitness to stand trial.

The court noted  after conflicting medical reports were presented regarding Kalombotole’s mental condition, with one assessment declaring him unfit to plead and another finding him fit to stand trial.

Kalombotole is accused of killing two patients at Kenyatta National Hospital in February and July 2025 but has never taken plea due to concerns over his mental status.

During proceedings, the court observed that a report from KNH indicated the accused was mentally unwell and required prolonged observation.

“He has to stay there for a very long time because the report you brought before this court shows your client is sick,” the judge said.

The prosecution, led by the Office of the Director of Public Prosecutions, proposed that the accused undergo a fresh examination before a three-member psychiatric panel at Mathari Hospital to conclusively determine his mental state.

“We are of the opinion that a three-bench panel of psychiatrists at Mathari should examine him,” the prosecution submitted.

Agreeing with the proposal, the judge said the court could not rely on contradictory medical findings without a more comprehensive assessment.

“He needs observation for quite some time for the doctors to properly examine him. I am not a doctor,” the judge stated.

The court further noted that if the psychiatrists fail to agree on Kalombotole’s condition, he could be referred outside the country for further assessment.

“If we do not agree to the three, we will take him to South Africa. I agree with Madam Timoi,” the judge added.

Lawyers representing victims in the case supported the fresh assessment but urged the court to ensure the matter is concluded without further delays.

“We pray for finality of this matter. I now have two contradictory reports, one saying he is unfit and another saying he is fit,” counsel for the victims submitted.

The case will be mentioned on July 24 for further directions and to review the findings of the psychiatric panel.
