Court certifies as urgent petition to cite Health CS Duale for contempt of court

Justice P. M. Nyaudi directed that the application filed against the Attorney General and the Health CS be heard on a priority basis.
The contempt application, dated June 10, 2026, was filed by the Katiba Institute, who argue that the Attorney General and the Health CS are in contempt of court orders issued on May 28, 2026, and June 2, 2026.
Through lawyer Malidzo Nyawa, Katiba Institute contends that the respondents have failed to comply with the court's directives, thereby undermining the authority and integrity of judicial proceedings.
"In concern with the necessity of preserving the integrity of the court proceedings," Justice Nyaudi certified the application as urgent and directed the respondents to respond.
The court ordered the petitioner to serve the application upon the respondents immediately and no later than the close of business on June 12, 2026. The Attorney General and the Health CS were directed to file their responses within 24 hours of service and, in any event, not later than June 15, 2026.
The judge also granted the petitioner leave to file a further affidavit by June 16, 2026.
The matter is scheduled for mention on June 16, 2026, when the court will issue further directions on the contempt proceedings.
