Court blocks arrest of Nairobi Hospital directors, any management changes

It is a reprieve for the directors of Nairobi Hospital after the High Court issued conservatory orders halting any form of arrest, prosecution, or interference with their management.

In a ruling delivered by Justice Bahati Mwamuye, the court barred the respondents, including Felix Koskei and the State Law Office, from summoning, arresting, detaining, charging, or continuing any prosecution against the six petitioners in relation to the hospital's governance and affairs.

The court further restrained the respondents, whether acting directly or through agents, from taking any steps that would alter the hospital’s leadership structure, including its directorship, membership, or administration, effectively preserving the current management.

The orders, however, are temporary and will lapse at the close of April 10, 2026, unless extended, varied, or set aside by the court.

The petitioners have been directed to serve all respondents with the orders and file an affidavit of service, as the matter heads to an interlocutory hearing scheduled for April 9, 2026.
