Businessman in court to block sale of Ksh.25 million apartment

In an urgent application filed before the High Court, Rukwaro claims that the bank, through Phillips International Auctioneers, unlawfully sold his home Apartment No. A5, Riverland Apartments on L.R No. 330/695 on August 22, 2025 despite an implied undertaking given in court that no sale would proceed before the hearing and determination of his pending motion.

He argues that on August 13, 2025, the bank’s advocate assured the court that the apartment would not be sold before the court delivered its ruling on September 19, 2025.

However, he alleges that the bank went behind his back, proceeded with the auction, and later credited his bank account with a purported balance of Ksh. 1 million from the sale proceeds.

Through his lawyer, the businessman is asking the court to declare the auction null and void for being conducted in contempt of court, to commit the bank’s officials and their advocates to civil jail for six months, and to impose fines of Ksh. 5 million and Ksh. 100 million against the respondents for contempt. 

He also wants the court to order an immediate halt to any steps towards completing the alleged illegal transfer of the property.
