Boda boda rider jailed for 40 years for defiling 8-year old girl

A statement by the Director of Public Prosecution on Tuesday revealed that the accused, Mwarabu Omar Pato, was slapped with the sentence after the prosecution led by PC Barbara Sombo proved the case against the suspect.

Appearing before Senior Resident Magistrate David Odhiambo, the court heard that Pato committed the hideous act on November 14, 2022, in the Mikanjuni area of Jomvu Sub-county within Mombasa County.

Magistrate Odhiambo ruled that the prosecution had tabled irrefutable evidence of identification of the offender, age of the victim, Post-Rape Care (PRC) and P3 documents.

“Mwarabu Omar Pato was convicted by Senior Resident Magistrate David Odhiambo, who ruled that the prosecution, through PC Barbara Sombo, had proven its case beyond reasonable doubt by proving the three ingredients of the age of the minor, penetration, and positive identification of the accused in the defilement case,” stated ODPP.

“Odhiambo also ruled that the evidence and testimonies of the prosecution witnesses were irrefutable, including the Post-Rape Care (PRC) and P3 forms, which showed that the complainant was indeed defiled.”
