A three-judge bench on Monday issued
conservatory orders halting proceedings of a High Court bench in former deputy
president Rigathi Gachagua's impeachment petition.
The former deputy president, impeached last October, filed an appeal challenging the decision of a three-judge
bench to hear and determine the petition challenging his removal from office by
the Senate.
The bench, comprising Justices Eric Ogola,
Anthony Mrima and Freda Mugambi, dismissed Gachagua’s application challenging
the Deputy Chief Justice (DCJ)’s authority in appointing the panel
presiding over his case.
Gachagua moved to the Court of Appeal
through his legal team, arguing that the High Court bench’s proceedings should
not proceed as initially ruled.
