Nairobi court orders extradition of Kevin Kang'ethe to face murder charges in the US

Murder suspect Kevin Kang'ethe is set to be extradited to the USA to face charges of killing his girlfriend Margaret Mbitu.

Nairobi Chief Magistrate Lukas Onyina on Wednesday ruled that material laid before the court established a link between Kang'ethe and the alleged offence of first-degree murder. 

Onyina further noted that the court, not being a trial court, is not mandated to conduct a trial to hear and determine the case against Kang'ethe.

“...and those form part of intended evidence to be handed over to the requesting state as required, and a proper inventory should be maintained. Orders accordingly,” ruled the court.

The court in its ruling further noted that the alleged offence against Kang'ethe, to which the extradition request and the Authority to Proceed relate, meets the necessary legal requirements.

“I, therefore, agree with the submissions made by counsel for the applicant that the dual criminality test has been met,” the court noted.

Similarly, the court said there is justification to have Kang'ethe extradited to the US.

Kang'ethe had opposed the application.

Kang'ethe is wanted in the US for the murder of Maggie Mbitu, his 31-year-old reported lover,  whose body was discovered inside a vehicle at Boston's Logan Airport in November last year.
