 MP Ochieng' threatens to present ouster motion if Masengeli fails to resign today

Ugenya Member of Parliament (MP) David Ochieng' has threatened to present a censure motion in the National Assembly to oust acting Inspector General of Police Gilbert Masengeli if he fails to resign by the end of the day, Tuesday 17, 2024.

In Ochieng's view, Masengeli has proven to be a rogue individual and cannot be trusted with the critical role of manning the Kenyan police force and protecting citizens.

He therefore argued that if Masengeli fails to leave office voluntarily he will initiate an ouster motion in the Legislation House to force his exit.

"If that gentleman does not resign by the end of the day today, I as David Ochieng' will take a censure motion to parliament for his removal from office. He must leave office. That should not even be debated," said Ochieng' speaking on Citizen TV's Daybreak Show.

"We cannot have Masengeli going back as IG its unquestionable."

The legislator further opined that Masengeli's brazen disobedience of the rule of law, after failing to honour seven court summons, should be frowned upon and should render him unfit for holding office.

"We are dealing with a decay in legal order and generally a free-for-all system that must be stopped immediately. If we don't do this tomorrow why would you expect someone who is found stealing or murdering to obey the law?" he posed.

He therefore called upon the National Police Security Council (NPSC) and the Interior Ministry to take apt action before public trust in the security authorities is eroded.

"They must take action forthwith, this cannot be allowed to stand even for a single day. Masengeli is not acting on his own. There must be someone telling him to stay put," he noted.

Masengeli had been expected in court to give a brief on the whereabouts of Bob Njagi, Jamil Longton and his brother Aslam Longton, who went missing on August 19, 2024, after being reportedly abducted by police officers amid the Gen Z-led anti-government protests. 

During the seven summons he skipped, the acting IG's team told the court that he was attending to critical matters.

Justice Lawrence Mugambi on Friday sentenced Masengeli to six months in prison after being found guilty of contempt of court.

The High Court judge ordered Masengeli to present himself to the commissioner general of prisons.

"In the event he doesn't submit himself CS Interior must take all steps to ensure he is committed to prison to serve sentence," said Justice Mugambi. 

However, the judge noted that Masengeli may avoid serving the sentence if he appears in court within seven days, failure to do so, the sentence will be effective.
