Meru MCAs withdraw impeachment motion against Governor Kawira Mwangaza

During the afternoon seating, MCA Zipporah Kinya who was the mover of the motion tabled a notice to withdraw the impeachment bid which was then debated and approved by the members.
"This assembly approves the request by the deputy leader of the majority party Zipporah Kinya to withdraw the notice of motion for the removal of office of Governor Kawira Mwangaza by impeachment whose notice was issued on Wednesday, July 17 2024,” said the Speaker.
One of the main reasons for the withdrawal of the motion was
that it was overtaken by time since such a motion ought to be debated and sent
to the Senate within 10 days after the notice.
Secondly, withdrawing the motion means the ongoing court case now lacks subject matter and will now be null and void.
Also, the withdrawal means that any MCA including the mover has a leeway to reintroduce the impeachment motion again since it has not reached the debating stage.
Court documents obtained by Citizen Digital show that
Mwangaza and her advocates should appear before Njuri Ncheke on Wednesday, July
31.
Njuri Ncheke was at the same time ordered to submit their
resolution or lack of it in the dispute not later than 3 weeks from, Monday,
July 29, with the ruling deferred to August 20.
The development came after the Assembly on Friday stopped the debating of the motion following a High Court order
issued on Wednesday which temporarily halted the proceedings until the court
provides further directions.
The ruling was preceded by Mwangaza filing a petition challenging the planned impeachment motion on grounds that the proposal is being instigated by her political detractors.
The impeachment motion was filed by Nominated Member and Deputy Leader
of the Majority Party Zipporah Kinya on grounds of gross violations of the
Constitution, various national and county laws, and abuse of office.
The notice of motion listed numerous specific allegations
against Mwangaza such as illegal appointments and dismissals, financial
misconduct, and misleading the public.
She was also accused of revoking the appointment of CPA
Virginia Kawira Miriti as Secretary/CEO of the Meru County Public Service Board
without proper authorization and in contravention of the law.
