Man gets nod to scrap name from child's birth certificate after DNA tests prove he is not biological father

Court documents reveal that the male identified as FOA moved to court on November 16, 2023, seeking his name to be struck out the minor's birth certificate after two DNA tests he conducted ascertained he was duped into believing he is the child's rightful father.

FOA had a romantic relationship with the child's mother, RAO, in 2014 as colleagues when she conceived and made him believe that he was responsible for the pregnancy.

He then started providing for the child's needs but as time lapsed he however became suspicious and stopped remitting financial assistance for the child's upkeep.

RAO then reported him to the Children’s Department for child neglect and was ordered to resume taking care of the minor.

Still dissatisfied, FOA proceeded to undertake a secret DNA test of the minor which resulted in him knowing he was not the biological father.

The child's mother then filed an affidavit on January 3, 2024, where she confirmed that FOA was indeed providing support for the minor, however arguing that he violated the child's rights by taking the DNA tests without her consent given that the baby is autistic.

The duo was then granted time to solve the matter amicably but upon resuming hearing on January 30, 2024, the court learnt that the matter was still unresolved and they both agreed to have a second DNA test at the government Chemist Laboratory in Kisumu.

On February 14, when the DNA report was filed in court, it was confirmed that FOA was not the minor's biological father.

The court therefore directed the Attorney General (2nd respondent) and Registrar of Births and Deaths Department of Civil Registrations in Kisumu West (3rd respondent) to reissue to the minor a fresh birth certificate without FOA's name.
