Lawyer Assa Nyakundi charged with manslaughter in son’s murder case

Lawyer Assa Nyakundi who is suspected of shooting and killing his son last month has been charged with manslaughter.

Nyakundi who was before Senior Principal Magistrate Bosibori Nyang’ena on Friday was however released on a cash bail of Ksh.300,000 and a Ksh.1million surety.

The court further ordered that the city lawyer vacate his Muthaiga North home immediately and he be escorted by the investigating officer, Oliver Nabonywe, to collect his personal items.

Lawyer Nyakundi told police he shot his 29-year-old son Joseph Bogonko Nyakundi on March 17, 2019 near his house.

The deceased was buried on April 2 at the Lang’ata Cemetery.

Nyakundi had earlier told police he was trying to holster his firearm while in the car when he accidentally fired, shooting his son in the chest.

However, an autopsy report seen by Citizen Digital indicated that: “The shot projection from the chest exiting at the back suggested that whoever shot him was standing outside the rear right back door of motor vehicle KCE 753B Toyota Axio which belongs to the father of deceased.”

The report which was released on March 21, also inferred that the cause of death was chest injuries and haemorrhage due to gunshot from a low velocity firearm.

It also revealed that he could have been shot from outside the vehicle and not inside as the lawyer claimed.

“The angle of shooting according to the projection could be ninety degrees, suggesting there was a confrontation,” the report adds.

Nyakundi will also be expected to report to the investigating officer regularly for the next 14 days.

The accused has been in hospital for six weeks was released on Tuesday this week.

He told the court that counselling sessions are ongoing in a bid to bring the family together.

On Thursday, the new investigating officer Oliver Nabonywe requested for an extra day to get Nyakundi’s finger prints.

He also wanted more time to visit the crime scene and interrogate the suspect further.

The case mention date was set as June 20, 2019.
