Kenya Railways blocked from fencing disputed land in Kisumu

Kisumu Environment and Lands Court has issued interim orders stopping the Kenya Railways Corporation (KRC) from fencing off parcels of lands belonging to the Karateng community in Kisumu County. 

KRC had begun the process of fencing off parcels of land near the railway line that it claims ownership, prompting locals to seek redress from the court.

Through lawyer Kenneth Amondi, the Karateng Community went to court saying over 200,000 residents from the community risk being rendered homeless as a result.

Kisumu Environment and Lands Court Judge Justice E. Asati certified the matter as urgent and ordered Kenya Railways to immediately stop fencing off the land parcels.

The fencing off resulted in the blocking of many roads in the area including Lela-Aboge, Lela-Holo, Lela – Sunga and Lela-Eluhobe.

Justice Asati also ordered KRC to stop hiving off portions of land belonging to the Karateng community, especially in Marera area pending a hearing and determination of the matter.

Their lawyer Amondi told the court that they have a survey report showing that the KR actions are erroneous and risk making many lose land and denied access to their homes.

The matter will be heard on January 23, 2024.
