The High Court has ordered the police
to produce lawyer Prof. Hassan Nandwa and his client Elgiva Bwire before court
within 24 hours.
Justice Anthony Mrima on Thursday
also ordered Safaricom to supply the Law Society of Kenya (LSK) and the court with
Prof. Nandwa’s phone call records.
"I have considered the
submission made and I'm satisfied there is reasonable circumstantial evidence
pointing out the high possibility that the second and third persons are likely in custody or at least they (police)
are aware of their whereabouts," the court stated.
The court added that it is
disturbing why the police have not yet appeared to explain the whereabouts of
the two persons.
“The matter to be fixed on November
8 for further directions," directed the judge.
The National Police Service (NPS) on Tuesday denied
knowledge of the whereabouts of abducted lawyer Prof. Nandwa, instead saying it
had launched investigations with the aim of bringing to book his abductors.
Prof. Nandwa was abducted when he left Jamia
mosque after evening prayers over a week ago.
His family said police raided the lawyer's Nairobi
home in search of Bwire that night.
