Four MPs take Jubilee Party Whip to court

Four Members of Parliament have moved to court challenging a decision by the Jubilee Party Chief Whip to remove them from various legislative committee positions within the National Assembly.

The four MPs; Alfed Keter (Nandi Hills), Silas Kipkoech (Moiben), David Bowen (Marakwet East) and James Gakuya (Embakasi North) argue the decision by Majority Chief Whip Benjamin Washiali to eject them from the parliamentary committees was unreasonable and irrational.

The Jubilee affiliated legislators also argue that the action was taken without prior notice, thus infringing their constitutional rights of due process and entitlement to a fair hearing.

Keter had been elected chair of the Labour and Social Welfare committee with Tiren set to head the Agriculture committee and Bowen the Environment and Natural Resources committee.

The four MPs are reported to have received letters from Majority Whip Washiali, removing them from parliamentary committees soon after securing their spots on the parliamentary committees.

According to Standing Orders of Parliament, an MP ought to be given an opportunity to be heard before being removed from a committee. The four parliamentarians argue this opportunity was not afforded to them.

Speaker of the National Assembly, Justin Muturi and Majority Leader Aden Duale have also been mentioned as respondents in the legislators’ case against Hon. Washiali.
