Former Homa Bay County doctor ordered to refund Ksh.5.8M in illegal salaries

A former Medical
Officer with the County Government of Homa Bay has been ordered to refund more
than Ksh.5.8 million in salaries illegally earned while working two full-time
jobs in violation of the Constitution.
In
a judgment delivered on Friday, July 11, 2025, the Milimani Anti-Corruption
Court found Dr. Boniface Oloo Otiato guilty of unlawfully drawing a salary from
the county government between August 2017 and August 2020, while simultaneously
serving as a Branch Manager at Avenue Healthcare in Kisumu.
Justice
Benjamin Musyoki directed Dr. Oloo to repay the entire sum of Ksh.5,808,056.90
to the government, along with interest from the date the suit was filed. The
court also ordered him to bear the full cost of the case.
The
Ethics and Anti-Corruption Commission (EACC), which carried out investigations
into the matter, said Dr. Oloo’s conduct violated Article 77(1) of the
Constitution and Section 26 of the Leadership and Integrity Act, both of which
prohibit full-time public officers from engaging in any other gainful
employment.
“The
judgment affirms the Commission’s commitment to safeguarding public resources
and enforcing ethical conduct within county governments,” EACC said in a
statement.
