Four petitioners want Caretaker Committee installed at Athletics Kenya

A petition has been filed in court seeking to compel the Cabinet Secretary for Sports to appoint a caretaker committee for Athletics Kenya.

The petitioners—Casper Cheruiyot, Evans Siro, John Mwania Wanzau, and Edward Mburu Mwaura—argue that the prolonged delay in appointing the committee has led to a significant decline in Kenyan athletics, resulting in poor performance and diminished motivation among athletes.

The court papers request an order of mandamus to direct the Sports Cabinet Secretary to appoint a caretaker committee. Once the committee is in place, the petitioners also seek a court order to amend the Athletics Kenya (AK) Constitution and to conduct new elections within 90 days.

The petitioners assert that the Sports Cabinet Secretary has the authority to remove any official from a sports organization. They emphasize the urgent need for new elections and constitutional amendments to address the current governance issues within AK.

The petition notes that the current Executive Committee of Athletics Kenya remains in place only due to a temporary stay order from the Court of Appeal.

The petitioners claim that this interim arrangement should be replaced by the appointment of a caretaker committee and the subsequent elections as required by the stay order.

The petitioners allege that the Executive Committee has stubbornly refused to appoint a caretaker committee, despite the guidance provided by the court order.
