Call for reforms after court rules KRA Board Chairperson's appointment illegal

The appointment of Anthony Mwaura as Kenya Revenue Authority (KRA) Board Chairman was on Monday declared illegal and unconstitutional. 

While revoking his appointment, High Court judge Francis Gikonyo noted that the national values and integrity were not adhered to while appointing Mwaura, adding that it was inconsistent with the constitution. 

This ruling has been widely applauded by various stakeholders including persons living with disabilities.

Mr. Hafid Maalim, Chairman of People Living With Disabilities - Northern Kenya, emphasized the urgency of implementing further changes to restore integrity and efficiency at the KRA.

He outlined several critical steps needed to address long-standing issues within the Authority:

Removal of Revenue Service Assistants (RSAs): The courts have previously declared the appointment of RSAs unconstitutional. Maalim stated, "These Kanjos who lack the requisite academic qualifications only harass wananchi." He called for their immediate dismissal to prevent further harassment of the public.

Abolishment of the VAT "Special Table": The current system imposes outrageous requirements on companies, leading to transactional delays and a culture of bribery. Some officers have been exploiting this system to demand large bribes for removing companies from the special table. Maalim urged the elimination of this system to foster a fair business environment.

Promotion of Qualified Officers: Promotions at the KRA have been suspended, resulting in deserving officers being overlooked. Hon Maalim highlighted the need to resume promotions to ensure that qualified individuals occupy key positions, thus enhancing the quality of service. "Most of those in high positions lack the requisite academic documentation while deserving officers serve in low ranks," he noted.

Retirement of Officers Above Sixty: The Authority is burdened with officers who have surpassed the retirement age but continue to hold onto their positions. Hon Maalim called for their retirement to pave the way for new talent and adherence to regulations.
