Boda boda rider handed 15-year sentence for assaulting, raping 50-year old woman

The convict, Fredrick Ojwang, is said to have raped and assaulted the woman on March 28, 2024 at around 2200 hours at Matufali village in Rongo Sub County, Migori Country.
He was sentenced by Principal Magistrate Susan Mutava who handed him 10 years for the offence of rape and an additional five years for the offence of assault.
"Considering the evidence on record vis-à-vis the relevant provisions of the law and principles set through precedent, the prosecution's case has been proven beyond reasonable doubt, and as such, the accused person is convicted for the offence of rape." "I equally convict the accused person of the offence of assault causing actual bodily harm," ruled the court.
The prosecution called four witnesses one of whom told the court that on the 28th of March 2024, he was on his way at 11:00pm, and when he reached Matofali area near a bush, he saw a parked boda boda. He saw two people on the ground, and he switched off his motorcycle and heard a woman screaming for help.
The Magistrate noted that the victim was very coherent and candid in the way she presented her evidence before the court.
The medical reports produced before court also corroborated that indeed there was penetration.
