Reprieve for Embarambamba as MP Silvanus Osoro intervenes, facilitates meeting with MCSK boss Ezekiel Mutua

Controversial gospel singer Chris Mosioma, alias Embarambamba, can now breathe a sigh of relief after a section of leaders from the Kisii community intervened in his dispute with regulatory bodies Kenya Film Classification Board (KFCB) and Music Copyright Society of Kenya (MCSK).

Led by South Mugirango MP and National Assembly Majority Whip Silvanus Osoro, the leaders organised a successful meeting with MCSK's Ezekiel Mutua and a representative from KFCB, where they agreed to take the matter out of court and follow the Alternative Dispute Resolution (ADR) route. 

This is after KFCB had fined Embarambamba Ksh 6.4 million for violating its code of conduct in his numerous gospel videos which have been deemed to be lewd and unpalatable. 

Embarambamba had also been ordered to pull down all the videos from his YouTube channel and apply to be allowed to make any film going forward. 

Speaking after the meeting, Osoro said they had managed to convince KFCB and MCSK to be lenient with Embarambamba, who then agreed to settle the dispute out of court and help the singer going forward. 

"We agreed that going forward we engage outside the courts and go the ADR way. And as you saw Embarambamba has already started acting on some of the demands by KFCB and that itself has shown a bit of remorsefulness and acting within the law as the body may want him to do," Osoro said. 

He also revealed that they agreed during the meeting that Embarambamba can continue with his worship and praise but within the limitations set by the regulatory body.

Also present during the Wednesday afternoon meeting was lawyer Danstan Omari, who took it upon himself to represent Embarambamba when the KFCB strike came. 

Omari said he had managed to convince KFCB to take the matter out of court and follow the ADR way. 

"The ban had caused a lot of problems to all the Kisii leadership, all the community was up in arms because Embarambamba is our brand in music, was now out of circulation. We decided to engage the entity in a manner that can resolve this dispute. We've agreed that this is a matter that we need to forge a relationship," Omari said.

Omari said if Embarambamba is put out of circulation then those who watch and enjoy his music will sue both KFCB and MCSK because artists who make mistakes should be corrected, not punished. 

On his part, MSCK's Mutua acknowledged the efforts put in to find a solution to the dispute. Mutua said Embarambamba's energy should be used in a good way, not to destroy property and make lewd content.

"Our desire as MCSK is to mentor creatives like Embarambamba and others. This is the space that can be created for our youth and artists and you are aware that we are not in the business of promoting immorality in our culture," Mutua said. 

"We all reached to one conclusion, that it is possible to deal with this matter under ADR which is recognised by law so that we mentor Embarambamba, we look at the penalties that have been spelt out and see how we can help together and make this talent a more useful and responsible contributor to the development of our country," Mutua added.

Embarambamba has continued to beg for forgiveness since he was handed the strike, saying his kids will lack food and education as he feeds them through his music. 

He has acknowledged his mistakes and promised to do better in the coming days.
