Tribunal extends orders blocking businessman from taking over Kilimani-based plaza

The Business Premises Rent Tribunal has extended interim orders restraining businessman Martin Nyongeso from taking possession of or interfering with commercial premises at Senteu Plaza along Lenana Road, pending the hearing of a dispute filed by SBS Dunhill Group (EA) Limited.

The orders, issued by Andrew Muma, will remain in force until July 27, 2026, when the matter will be mentioned for further directions.

SBS Dunhill Group moved the tribunal seeking to have Nyongeso enjoined as the third respondent and to stop him, his agents or employees from interfering with its quiet possession of L.R. No. 1/1373 (Original Numbers 1/989 and 1/990), Senteu Plaza.

In court documents, the company claims it was unlawfully evicted from the premises in May 2025 after the landlord allegedly obtained ex parte orders without serving it with the pleadings or the orders. It further alleges that the eviction was carried out in the presence of more than 15 police officers.

The company says it later secured reinstatement orders from the tribunal but has been unable to regain possession of the premises, accusing the landlord and Nyongeso of continuing to block its access.

SBS Dunhill also argues that a separate case filed by Nyongeso, through which he had obtained orders protecting his occupation of the premises, was struck out in January this year, effectively lifting the injunctions that had prevented enforcement of the reinstatement orders.

The company is seeking orders restraining the landlord and Nyongeso from interfering with its occupation of the premises and has also asked the tribunal to direct the Officer Commanding Station (OCS) Kilimani Police Station to enforce its orders.

The matter will be mentioned on July 27, 2026.
