The Political Parties Disputes Tribunal (PPDT) has ruled in favour of Orange Democratic Movement (ODM) Secretary General Edwin Sifuna, finding that the party violated his right to a fair hearing before initiating disciplinary proceedings aimed at removing him from office.

In a judgment, the PPDT held that ODM failed to adhere to the principles of procedural fairness 

The Tribunal found that the party's actions contravened the requirements of due process, rendering the disciplinary steps taken against the Secretary General procedurally unfair.

However, the Tribunal clarified that its decision does not bar ODM from taking disciplinary action against Sifuna.

It ruled that the party is at liberty to institute and conclude fresh disciplinary proceedings against the Secretary General, provided they are conducted strictly in accordance with the law, the party constitution, and its internal rules.

The Tribunal also vacated all interim orders that had been issued during the pendency of the case.

The ruling means that while the disciplinary process previously initiated against Sifuna has been faulted for violating due process, ODM retains the authority to pursue the matter afresh, provided it complies with the requirements of procedural fairness.
