Over 1000 residents move to court to block eviction from Njiru land

The residents want the case to be certified as urgent and the eviction order delivered on October 23 be temporarily stayed pending a hearing and determination of their case.

“This court be pleased to order for a stay of execution of the judgment issued 23rd October pending hearing and determination of this application,” reads court papers.

It is their claim they have been residing in the disputed land for over 40 years -50 years and the said judgment will affect them.

“The applicant does not concede to being an encroacher having bought the said land, issued with certificates and issued allotment letters by county council,” they say.

They say that the will suffer irreparable harm if the court does not issue and order staying the execution of the judgement.

“Several households belonging to the applicant, schools, churches hospitals and other public amenities are set to be demolished subject to the judgement of this court, and an irreparable damage shall be occasioned on the applicants to their detriment owing to the fact that they have ordinarily been residing there with the knowledge of the legal owner,” they argue.
