The court heard that Sagero murdered Mongina on April 18, 2024, at around 9:00 A.M. in Borioba Village, Borangi Location, Nyamira North Sub-County.
Sagero denied the murder charge during the trial, while the prosecution, led by Deputy Director of Public Prosecutions Joel Kibet Chirchir, presented evidence seeking to establish the elements of the offence beyond reasonable doubt.
Six witnesses testified for the prosecution, with their evidence linking Sagero to the killing. A doctor who conducted the post-mortem examination said Mongina died from severe head injuries caused by blunt force trauma, which resulted in a cardiovascular arrest.
Medical evidence also showed that Mongina had suffered repeated blows to the head, resulting in a fractured skull and extensive bleeding in the brain.
The court found that the severity and nature of the injuries showed deliberate intention to cause harm. Therefore, the prosecution established the murder charge beyond reasonable doubt.
As a result, Sagero was sentenced to 15 years' imprisonment and granted 14 days within which to appeal the sentence.
