MP Mukunji demands end to 'intimidation' amid probe into Embu chaos

The lawyers have also accused the state of sending contradictory signals over whether their client is a suspect.

In a letter dated September 15, 2026, the law firm Ndegwa and Ndegwa Associates said Mukunji learnt through a statement by Government Spokesperson Charles Owino, aired on Citizen Television, that police were allegedly pursuing him over the Nembure violence. 

According to the law firm, the position the firm says contradicted earlier indications from the police that he was not under investigation.

"Our client is therefore left in a state of complete and justified bewilderment as to which of the two conflicting positions is the official and truthful stance of the state," the lawyers wrote.

The violence broke out on Saturday, September 12, during a United Democratic Alliance delegates' meeting at Nembure Grounds in Embu County, presided over by Deputy President Kithure Kindiki and attended by Embu Governor Cecily Mbarire and other senior leaders.

The National Police Service said one person died and six vehicles were torched as officers used tear gas to repel a group that attempted to storm the venue. 

The Directorate of Criminal Investigations has since arrested at least three suspects linked to the unrest and said more arrests were expected.

Mukunji has publicly distanced himself from the chaos, and his lawyers reiterated that position in the letter, stating that he "categorically, unequivocally, and without any reservation whatsoever" condemns what happened at Nembure Ground. 

The firm said the MP remains willing to cooperate with any lawful and impartial investigation but would resist what it called any attempt to make him a "scapegoat" for the violence.

The letter also raises questions over who authorised the use of force that led to the deaths, stating that the two people who died succumbed to gunshot injuries. 

The lawyers claim it is "a matter of public record" that Deputy President Kindiki was heard issuing orders connected to the shooting, an allegation the firm frames around Article 27 and Article 143 of the Constitution, which the advocates say confirms the Deputy President does not enjoy immunity from criminal prosecution.

The advocates further demanded that police and DCI officers "immediately and permanently cease and desist" from what they described as surveillance and harassment of Mukunji's family, including his school-going children, at his rural home in Mutunduri.

Police were seen camped outside the MP's home on Sunday, a development the lawyers characterised as unlawful. 

Eastern Regional Police Commander Stephen Chebet has said the officers were on routine patrol and that the MP's home area was not restricted, adding that police would question Mukunji only if investigations established he was linked to the violence.

Owino, responding to questions on September 14, defended the police pursuit of Mukunji, saying investigators had a reason for seeking him but declining to disclose what had been established before he was located and questioned. 

Former Deputy President Rigathi Gachagua has separately accused Kindiki and Mbarire of using security agencies to intimidate Mukunji, a claim the DP's camp has not directly addressed.
