Magoha’s name withdrawn from CBC case

High Court has removed the name of the late Education Cabinet Secretary Prof. George Maghoha in the Competency-Based Curriculum (CBC) case.

This is after lawyer Nelson Havi who is challenging the new curriculum made an application to have the late Magoha withdrawn from the case.

The application was allowed. 

Magoha had been listed as the 8th respondent in the case and through his lawyers Phiilip Murgor and George Ouma had filed his responses and submissions.

Meanwhile, the Attorney General has been given seven days to file the CBC Taskforce Report with the respondents and appear in court on February 15 for directions.

In the case, Nelson Havi is challenging the CBC curriculum, terming it unconstitutional.

The petitioner argues that CBC was rolled out without prior preparations and consultations adding that its implementation will harm children's future because the teachers were ill-prepared.
