Kitui Assistant Chief arrested for issuing burial permit without proper documentation

An Assistant Chief in Tseikuru Sub-County, Kitui County, has been arrested and arraigned for allegedly neglecting official duty.

The accused, Mwathiki Musili, who is the assistant chief of Kamuthanga Sub-Location, is said to have issued a burial permit without first securing a medical certificate confirming the cause of death as required by law.

According to the Directorate of Criminal Investigations (DCI), Musili was nabbed by Tseikuru Sub-County detectives, detained, before his file was forwarded to the Office of the Director of Public Prosecutions (ODPP) for prosecution.

“After review, the ODPP concurred with the investigating officer's recommendation to charge Musili with Neglect of Official Duty, Contrary to Section 128, as read with Section 36 of the Penal Code,” stated the DCI.

DCI noted his offence is a serious violation of protocol that ensures public safety and compliance with legal standards.

Appearing before the Kyuso Law Court, Musili pleaded not guilty to the charges levelled against him and was subsequently granted Ksh.70,000 bail.

The case is scheduled for mention on January 7, 2026.
