High Court suspends NTSA order revoking Nicco movers' licence

Justice Janet Mulwa has issued an interim stay stopping the implementation of the National Transport and Safety Authority’s judgment and orders issued on August 31, 2026, until September 22, when the matter will return to court for further directions.

The orders follow an urgent application filed by Nicco Movers, which argues that the suspension of its PSV operator’s licence has brought its fleet of more than 100 commercial vehicles to a standstill.

The company, through lawyer Danstan Omari, claims it had complied with the statutory and regulatory requirements raised by NTSA and is in possession of valid compliance certificates and other documents to demonstrate compliance.

According to the application, the immediate suspension has exposed the company to substantial and continuing financial losses, with the losses increasing for every day its operations remain grounded.

Nicco Movers argues that unless the court intervenes, the suspension could threaten the viability and continuity of its business while exposing it to further financial and operational liabilities.

Justice Mulwa has certified the application as urgent and directed that it be served on the respondents within 24 hours.

The respondents have been given seven days after service to file their responses, if any.

The court will hear the parties on September 22, 2026, when further directions will be issued on the disposal of the application.

The interim stay means that, for now, the NTSA judgment and orders suspending the PSV operator’s licence remain on hold pending the court’s further orders.

The case stems from an August 31 decision by the Transport Licensing Appeals Board, which suspended Nicco Movers’ PSV operator’s licence over compliance concerns raised by NTSA.

"The impugned desicion is causing the appellant grave prejudice and threatens the viability and continuity of the business," read court papers.
