High Court allows law firm to withdraw from Ksh.145B Foxcapital-KCB case

The High Court has granted Nyachoti & Company
Advocates leave to cease acting for Foxcapital Investment Limited in its Ksh.145
billion dispute with KCB Bank (Kenya) Limited.
Lady Justice Rhoda Rutto allowed the law firm’s
application dated September 10, 2026, during a mention before the court on
September 17.
The court further granted Foxcapital 14 days to
regularise its legal representation following the withdrawal of its advocates.
The matter will return to court on October 27,
2026, for further directions on how the case will proceed.
Nyachoti & Company Advocates had sought the
court’s permission to withdraw from representing Foxcapital, citing
difficulties in obtaining further, accurate and sufficient instructions from
the company after KCB filed documents and affidavits in response to the suit.
The firm, through lawyer Philip Nyachoti, also
asked the court to make directions on the costs of the application.
In the order issued on September 17, Justice Rutto
stated: “The application to cease acting dated 10th September 2026 is hereby
allowed.”
The judge consequently granted Nyachoti &
Company Advocates leave to cease acting for Foxcapital in the case.
The dispute involves Foxcapital and KCB Bank and
concerns a claim valued at Ksh.145 billion.
With the withdrawal now formally allowed,
Foxcapital has until early October to regularise its representation before the
case comes up for further directions on October 27.
