According to the , detectives from the Land Fraud Investigation Unit (LFIU) apprehended Githiari following investigations into claims that he fraudulently obtained money from the couple under the guise of a land sale and construction agreement.
Investigators said the couple had entered into a deal with Githiari for the purchase of a parcel of land in Ngong, where a double-storey house was to be constructed. Githiari, who allegedly presented himself as both the land seller and contractor, was tasked with overseeing the entire project.
The agreement placed the total cost of the land and construction at Ksh.40 million, to be paid in instalments. The complainants subsequently transferred Ksh.6.4 million to Githiari as part of the agreed payment.
Following investigations, detectives said they gathered sufficient evidence linking the former legislator to the alleged fraud.
"Subsequently, a duplicate police case file was forwarded to the Office of the Director of Public Prosecution (ODPP). Upon review, the ODPP agreed with the investigating officer’s recommendation to charge Githiari with the offence of obtaining money by false pretences, contrary to Section 313 of the Penal Code," said the DCI.
Githiari was arrested at his Karen residence and is set to be arraigned on Friday, May 15, 2026.
