The tussle over the distribution of the estate of the late prominent Uasin Gishu politician and farmer Mzee Jackson Kibor among his family members has taken a new twist.

The High Court sitting in Eldoret ordered that the contested Will produced in court by the deceased's widow Eunita Kibor should be subjected to forensic examination within 10 days.

Justice Reuben Nyakundi in his ruling directed that the Directorate of Criminal Investigations (DCI) be at liberty to secure any samples, tools, and writings from the deceased’s estate in collaboration with his youngest wife and lawyer Jonah Korir, the drafter of the contested Will.

The 27 children of the late Mzee Kibor and his two other surviving wives have ganged up against the youngest wife claiming that the Will she produced in court was questionable and does not reflect the wish of their late billionaire. 

They have rejected the Will which Eunita had defended, claiming that it is a genuine document left behind by the late tycoon showing how he wished his empire is distributed among his family members.

According to the late tycoon’s children and surviving wives, through a battery of their lawyers among them Ken Maiyo and Nixon Koitui, the deceased was not of his sound mind and the Will was made under dictated instructions which neither represent his intentions nor wishes.

Challenging the Will in their application, the objectors prevailed upon the court to set aside the document arguing that the deceased was not competent to make decisions as he was battling illness.

Mzee Kibor, who left a vast estate spread in Rift Valley, Nairobi and Mombasa counties died in March 2022 at a private hospital in Eldoret town aged 80 years.
