In a ruling delivered on October 29, 2026, Justice Biomdo granted the Commission's application to preserve the assets pending the hearing and determination of the recovery suit.
The orders restrain Nyaga from selling, transferring, disposing of or otherwise dealing with the properties.
The EACC filed the suit on August 28, 2026, against Nyaga and six companies allegedly associated with him: Truco Enterprises Ltd, Peanco Ltd, Njewaco Ltd, Hasoco Ltd, Hiwco Ltd and Isaac & Timothy Company Ltd.
The anti-graft agency is seeking to recover Ksh.111,577,188.75, which it claims was irregularly acquired from the Embu County Government through business transactions involving five of the companies.
According to the Commission, investigations established that Nyaga engaged in business with the county government through companies in which he allegedly had an interest, creating a conflict of interest.
The Commission further alleged that part of the money was used to acquire a parcel of land, Mbeti/Kiamuringa/49, registered in the name of Isaac & Timothy Company Ltd.
The Commission also linked the funds to the acquisition of six motor vehicles bearing registration numbers KDD 932H, KDC 857D, KDL 451F, KCQ 172W, KHMA 624H and ZF-9309.
As part of the preservation orders, the court directed the Land Registrar and the National Transport and Safety Authority (NTSA) to place restrictions on the properties, preventing their transfer, leasing or encumbrance.
The orders are intended to preserve the assets as the court determines the EACC's recovery claim.
The case will proceed to determine whether the funds were irregularly acquired and whether the properties should be forfeited to the State.
