Court bars Kiambu County from proceeding with doctors recruitment exercise

Employment and Labour Court judge Hellen Wasilwa has issued orders barring the Kiambu Court from hiring doctors pending the hearing and determination of a case filed by Dr Gathoni Muriithi. 

"The application is certified urgent and allowed in terms of prayers B and C of the NOM. This application should be served upon the Respondents and be heard inter partes on the 28th October 2025," reads the order.

The applicant moved to court, arguing that by a public advertisement, the County Government of Kiambu invited interested applicants for various positions under the Department of Health. 

The deadline of the said application was October 15, 2025. However, when she submitted her application on October 15, she learnt that the County Government had already shortlisted candidates and interviews were done.

“The Petitioner immediately visited the Respondents website and confirmed that indeed the Respondents had already shortlisted candidates and scheduled them for interviews before expiry of the deadline on 15th October, 2025,” read court papers. 

Gathoni, an Obstetrics and Gynecologist argues that the respondent purported to act capriciously, unjustly, unfairly, irrationally, unreasonably, maliciously, in bad faith, unlawfully and unconstitutionally against her and members of the public.

"The petitioner had been adversely affected and aggrieved due to the respondents' impinged actions," reads court papers, further accusing Kiambu County of violation labour laws.
