72-year-old man slapped with three life sentences for defiling minors, sharing pornographic material

A 72-year-old man has been sentenced to three life terms and another 30 years’ imprisonment after a Mombasa court found him guilty of defiling four minors and exposing them to pornographic material.

The accused, Kazungu Kalume Begande, appeared before Mombasa Law Courts Senior Resident Magistrate David Odhiambo, who convicted him on five counts of defilement and one count of child pornography.

According to the Office of the Director of Public Prosecutions (ODPP), the court imposed life sentences for three counts involving minors aged six, nine and 12, and an additional 30-year jail term for defiling a 13-year-old.

“Begande exposed the four minors to pornographic material over a period of more than one year after defiling them. The convict, who was also charged with alternative counts of committing an indecent act with a child, committed the crimes between 2022 and July 2023 in Misufuni area, Likoni Sub-county,” the ODPP stated.

The court heard that Begande, who was a neighbour to the victims, lured the children to his house under the pretext of watching television, where he exposed them to pornographic videos before sexually abusing them.

During the hearing, the minors told the court that the accused would sometimes give them Ksh.20 or Ksh.50 and warn them against disclosing the acts.

The ODPP noted that medical evidence presented by a clinical officer showed injuries consistent with defilement.

“A clinical officer who produced medical evidence testified that examinations conducted on the minors revealed broken hymens, vaginal lacerations, discharge and other injuries indicative of defilement,” stated the prosecution team.

In delivering the judgment, the Magistrate noted that the prosecution had proved its case beyond a reasonable doubt through the testimonies of 10 witnesses, including the minors, their parents, medical personnel and police officers.

The court further ruled that the prosecution’s case was strengthened by a confession made by the accused at the time of his arrest before a senior police officer. The Magistrate found that the confession was voluntary and recorded in accordance with the law.

Begande had denied the charges, claiming he had been framed following a dispute over a debt with the mother of one of the complainants.
