The recent High Court ruling declaring that Kenya Kwanza was never the rightful majority party in the National Assembly has left many Kenyans asking a fundamental question, why now? Why did it take over two years to rectify what was already clear from the start? The delay in delivering this judgment is yet another reminder of the systemic inefficiencies in our judicial system, where critical rulings often come too late to make a difference.
By the time this ruling was issued, the political landscape had already shifted beyond recognition. Many opposition MPs from Azimio have since crossed over to support the government, some even securing Cabinet positions in Kenya Kwanza. Azimio, once a formidable opposition force, is now divided and weakened. The parties that formed the coalition are no longer in sync, and in reality, there is no strong opposition in Parliament today. To add on to this, the President is campaigning for Azimio’s leader to be the AUC chair.
If this ruling had come in 2022, when the parliamentary majority question was still a highly contested issue, it could have significantly reshaped the country’s political direction. But in 2025, just two years before the next general election, the ruling serves little more than an academic purpose. Kenya Kwanza has already enjoyed the benefits of majority rule for two years, making the judgment feel like a case of too little, too late.
This is a clear case of justice delayed, and as the saying goes, justice delayed is justice denied. The Judiciary must move with urgency on matters of national significance. Some cases require immediate attention because their impact is time-sensitive. A ruling that takes years to arrive, long after its relevance has faded, does not serve the people.
As we approach the 2027 elections, the Judiciary must learn from this mistake. Critical rulings should not be made at a time when they are merely symbolic. The courts must rise above unnecessary bureaucratic delays and ensure that justice is not just done, but done at the right time. Otherwise, Kenyans will continue to lose faith in the system.
