SDT strikes out KNSC officials’ appeal, orders for fresh elections
The Kenya National Sports Council (KNSC) officials have suffered a huge blow after the Sports Disputes Tribunal (SDT) refused to rescind its last year’s decision that nullified the council’s 2022 elections.
The SDT not only nullified the elections but also barred the council’s chairman Nderitu Gikari, his deputy Charles Nyaberi, and treasurer Vanraj Sarvaiya from vying, citing that they had served two statutory terms since 2013.
The tribunal directed fresh elections to be held within 30 days in compliance with the 2013 Sports Act and the Sports Registrar’s Regulation of 2016.
“The 2nd, 3rd, and 4th respondents are constitutionally and statutorily barred from contesting or being elected as officials of the Kenya National Sports Council,” the tribunal ruled.
The appeal by the trio to overturn the 2022 ruling was dismissed, with the SDT maintaining its stance that the polls were invalid.
In addition, the SDT reaffirmed that the current office bearers are in office illegally, emphasizing the need for a lawful process.
“An order be and is hereby issued directing the 1st respondent to organize and conduct a fresh election in strict conformity with clause 16 and clause 17 of the Constitution of the Kenya National Sports Council, the Sports Act, and the Constitution of Kenya within 30 days.”
“An order is also issued directing the IEBC to conduct a fresh election right from the nomination of candidates to the declaration of the winners for the sole purpose of conducting democratic elections for the 1st respondent within 30 days,” ruled Justice J.K. Ng’arng’ar.
