Win for Jimi Wanjigi as firearms case dismissed, court rules DPP violated the law

The High Court has barred the prosecution of businessman Jimi Wanjigi in a firearms case, citing constitutional violations.

The decision, delivered by Justice Bahati Mwamuye, marks a victory for Wanjigi, who has been embroiled in legal battles with the state over firearm-related charges.  

The case, which stemmed from allegations of illegal possession of firearms, was dismissed on grounds that the respondents had failed to follow due process. The court further declared the revocation of his firearm certificate null and void.

Additionally, the respondents were restrained from pressing any criminal charges related to the matter.  

The court also ruled that the prosecution of Wanjigi’s employees, Duncan Odhiambo and Calvin Ochieng, was unconstitutional, as their rights had been violated, amounting to an abuse of the court process.  

The court found that the Director of Public Prosecutions (DPP) had acted inconsistently with the Constitution, leading to the termination of the criminal proceedings against them.
