War Memorial Hospital wins court battle against Nakuru County Gov't
Push and pull continue to rage the War
Memorial Hospital after hired goons again infiltrated the hospital during a
reopening leaving the workers in limbo despite six court orders that the Nakuru County Government has so far ignored.
It is still a puzzle who is
behind the interferences and protection of the government despite court orders
barring anyone from the hospital's operations that sits on a 25-acre land and has been in
operation for over 100 years.
The Hospital staff and management still
face obstacles in accessing the facility even though six court orders issued
between October 2023 and January 2024 were blatantly ignored.
The Nyandarua Environment and Lands Court
rejected an application by the County Government of Nakuru to set aside the
orders protecting the War Memorial Hospital. These orders prohibit any interference by the
County Government in the hospital's affairs and property possession.
The county police commander has been tasked
with ensuring compliance. However, challenges persist as the hospital fights to
maintain control.
War Memorial's lease title, initially
issued in 1922, was renewed for 50 years in 2021. However, a recent complaint by the
County Government of Nakuru led to its cancellation on May 19, 2023.
The court found it puzzling that Land
Registrar Erick Nyamu chose to publish a notice of 'loss' of the certificate of
title, despite no such loss being reported by the hospital management.
