Wajir Woman Rep Fatuma Jehow wants Gedi’s petition challenging her win dismissed
Wajir Woman Representative Fatuma Abdi Jehow now wants a petition filed against her by her predecessor Fatuma Gedi Ali dismissed for lack of service.
Jehow claims that the petitioner failed to
pay security for the costs as required by the law.
"The legal provisions for depositing
security fees of Ksh. 500,000 are couched on mandatory terms and should be complied
with strictly but the petitioner has failed to comply," reads the court papers.
Further, she argues that she learnt of the election petition against her through a gazette notice filed on the 15th of September 2022 which appointed judges to hear and determine the election petitions filed countrywide.
Jehow, therefore, alleges that she was never served with the petition on time as required by the law.
"The instant petition and witness affidavits were filed on the 8th September hence by law should have been served upon the third respondent on or before the 23rd of September in strict compliance with the rules...," stated the documents.
Jehow won the Wajir Woman Rep elections after
garnering 36,064 votes beating 11 other candidates battling for the seat, among them Gedi who managed 22,956 votes.
The application will be heard next week
